Data transmission in a radio telephone network

So lets see how this might work with one of the patents in the list. First starting point is to look on the patent i.e. it seems to exist and is issued. In addition patent has priority date of September 6th 1993 i.e. it was invented before first iPhone was in the market.

From the actual substance relating to Compliant. Nokia says that said patents cover some ETSI essential elements. According to ETSI IPR data based Nokia has issued declaration to ETSI that said patent is essential. More specifically patent is said to be related to 3GPP TS 23.401 standard (in ETSI declarations) and there to sections 5.7.4, 5.7.5, 5.4.5, 4.7.2, 5.4.5, 4.7.3 of version 8.2.0 of the standard.

Now the question is that can one map claims of the patent to said sections of the standard or not? When looking on the standard and the text we can at least say that will not be easy task to explain relationship to jury. On the other hand it will probably not be easy to say that there is no relationship either.

Story Continues...at some time in the future
